I. CALL TO ORDER
Chair Toby Rushforth called the meeting to order at 6:55 pm. There was a quorum.

II. ADMINISTRATIVE BUSINESS
A. Community Input -
Kia Weaver (student intern) – Weaver and McMahon presented a powerpoint presentation on KBAC’s updated “Ko’olaupoko Water Quality Information Database”.
B. Maile M. Bay – Executive Director’s Report
1. The planning firm of Wilson Okamoto Corp. has completed its draft Kaneohe-
Kahalu’u Stream Restoration & Maintenance, A Community Guidebook, (August
2003) prepared on behalf of the City and County, Department and Design and
Construction, and is requesting comments from the community. KBAC staff,
Malama Souza and Mike McMahon reviewed and submitted comments to the City
on the draft and attended the watershed fair at Windward Mall on Saturday,
November 8, 2003, with KBAC’s display.2. KBAC staff, Maile Bay, Mike McMahon, and Malama Souza met with Department of Health staff on supporting a proposal submitted on behalf of the City and County of Honolulu to install at least 3 hydromodification devices in Ko’olaupoko. Details to be discussed in Executive Session.
3. KBAC pre-proposal to develop a BMP Park adjacent to the shoreline of Ka‘elepulu Pond was accepted as one of the top 10 by the Department of Health. On October 16, 2003, KBAC staff, Malama Souza, and KBAC Councilmembers Jeff Harris and Scott Derrickson met with DOH staff to discuss KBAC’s pre-proposal and, on November 3, 2003, submitted a “best and final proposal”. The final proposal and all of the letters of support are attached. The landowner for
Parcel B faxed a letter of support to DOH agreeing to meet with KBAC about her
property. DOH predicts advising about proposal acceptance by November 17,
2003.4. During my travels came upon a potato byproduct made into “picnic ware” that is
“compostable”. The cost is about $6.50 for a set. KBAC could order a gross of
these and pass them out as a means of reducing long-life litter and solid waste.
This stuff can be put right into your compost bin. A sample will be brought to the
meeting to be viewed. KBAC could put a sticker on the packages and give them
out at KBAC events and to volunteers as kokua.Action: Approve purchasing a gross.
A motion was made by Derrickson and seconded by Brittain to purchase a gross.
Vote: 6 nays.5. With the two projects on the horizon for a BMP park/hydromodification devices and current contract obligations, KBAC needs to determine its future, i.e., whether to seek additional funds to continue disbursing contract money and conduct projects or other purposes including becoming a permanent entity. Staff recommends holding a facilitated workshop for KBAC at its next meeting scheduled in January 2004 to consider and establish the next steps for the organizations. Staff would work with the Executive Committee to develop the agenda and working papers for KBAC for that workshop. In light of this proposed task, recommend KBAC abeyance the revised KBAC master plan with DOH funding until after the workshop.
Action: Vote to hold a facilitated workshop for KBAC members and staff in
January 2004.
A motion was made by Brittain and seconded by Harris to hold a facilitated workshop with KBAC members, staff and selected others with the opportunity for feedback from stakeholders prior and that the meeting be structured for other than KBAC attendees to give us their input then the meeting would be closed for executive session . Vote: 6 ayes.
A tentative date of January 24, 2004 (Saturday) has been selected.6. DOH has circulated an evaluation form for pollution, its control, and effectiveness of efforts. PILI staff will be completing a form and recommend that each member submit his/her opinion. Also, DOH has requested that the form be distributed to others for input; please feel free to share.
7. Chuck Prentiss has requested a KBAC review of a stream cleanup pre-proposal for Inoaole Stream and whether KBAC will consider $5,000 based on a formal proposal. Gerald Silva advised that this stream is under the State’s jurisdiction and perhaps needs both State and U.S. Army Corps approvals/permits.
Action: Provide feedback on whether KBAC is open to this type of proposal.
Discussion ensued and Director Bay will refer Dr. Prentiss to the Waimanalo construction coalition who is willing to assist with heavy equipment. It was
further proposed that the community be informed that KBAC is not currently evaluating proposals.8. On September 29, 2003, Department of Health circulated a memo stating that rules will not be promulgated for NPS pollution control based on the attached opinion by the State Deputy Attorney General. The opinion appears to advise that the State has sufficient laws that enable it to bring a civil action to require “nonpoint source polluters implement all federally required ‘management measures’ to bring the source in question into compliance with the WQS and other applicable laws and regulations.”
9. Muriel Seto, kupuna, and member and Chair of the Culture Committee, Hawaii’s Thousand Friends, will be giving Director Bay a culture tour of the Kaneohe Marine Corps Base on November 20th, to ensure that we get the facts correct in KBAC’s revised master plan.
10. Malama Souza attended Dr. Doug McKenzie-Mohr’s presentation on sustainable environmental efforts on October 27, 2003. A summary of his
philosophy is attached.11. KBAC Contractors’ status and proposals: Matrix and attachments on contractors to be presented in executive session will be forwarded under separate cover.

1. Created maps of candidate hydromodification sites after site visits with Maile Bay, John Goody, Gerald Takayesu, and Jeff Harris. The C&C Storm Water Branch and the State Department of Transportation provided additional information such as pipe diameters and drainage areas (http://www.kbac-hi.org/319/).
2. Created maps of potential BMP park sites around Ka‘elepulu.
